Canceling a Listing Agreement
Canceling a listing agreement is as simple as asking the agent to cancel the agreement. However, if your agent refuses, you may need to go to the agent’s broker to request a cancellation. Most brokers will follow through with the request, as they want to maintain a good relationship with their community. Additionally, talking to a broker may be easier if you do not want to speak with an agent face-to-face. In most cases, your agreement that you signed is with the broker anyways, instead of a specific agent. However, if the broker refuses, you can ask to be placed with another agent in their company. If all else fails, contact a real estate lawyer for help and let your broker know that you will be contacting a lawyer. Sometimes, this will be enough for your broker to let you go.
Canceling a Buyer-Agency Agreement
If you are a buyer looking to cancel an agreement with an agency, ask your agent for a Termination of Buyer Agency form. This will cancel any oral or written agreement between you and the agency. If you think you will have trouble facing your agent, consider sending an email to your agent instead of going face-to-face. If you are an agent who wants to cancel your agency agreement with a buyer, a way to help the situation is to suggest your client would be the best fit with another agent in your agency.
